This course will equip delegates with the skills necessary to work towards resolving disputes expeditiously and amicably, with the objective of restoring the relationship between the parties.  The course focuses on amongst others: conflict resolution, communication, negotiation and people management.

Adjudication in the construction sector is a vast growing dispute resolution mechanism. Most standardised contracts prescribe the adjudication procedure as a precondition to referring a dispute to arbitration.

This two day course will equip learners with the skills and knowledge of:

• Construction law and its foundation

• Construction practice and terminology

• Different dispute resolution methods and comparisons

• Adjudication procedure in accordance with the Tribunal’s rules and provision of the various standardised contracts

• Problems with adjudication clauses and properly drafted adjudication clauses

• The role of the adjudicator

• When to refer a dispute to adjudication

• Making an award

Arbitration has become the preferred mechanism for reaching finality of disputes. Most standardised contracts contain arbitration clauses and the parties prefer arbitration as opposed to litigation.
